Terms of Use

Software: StorageSweeper (“the Software”)
Provider: Adi Vizgan (“the Provider”)

By purchasing, installing, opening, or using the Software you (“you,” “the User”) agree to these Terms of Use in full. If you do not agree, do not purchase, install, open, or use the Software.

These Terms of Use govern your use of the Software. The actual purchase transaction (payment processing, invoicing, refunds, chargebacks) is governed by the separate terms of service of Paddle (the “Reseller,” acting as the Merchant of Record). In the event of a conflict between the Reseller's terms regarding the purchase transaction and these Terms regarding your use of the Software, the Reseller's terms govern the transaction and these Terms govern the Software.

1. License grant

The Provider grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software, subject to these Terms.

The license is:

You may not:

Sharing your license key or attempting to bypass activation is a material breach of these Terms and may result in immediate revocation of your license without refund (see Section 9).

2. Nature of the Software

The Software is a disk-cleanup utility that can permanently delete files, application data, system caches, simulator runtimes, and similar artifacts on your Mac. Some operations:

These actions can result in permanent loss of data, removal of installed applications, loss of application preferences, sign-outs, broken integrations, and, in extreme cases, degraded macOS behavior.

3. Purchase, activation, and license keys

3.1 Purchase

Purchase of the Software is processed by Paddle, which acts as the Merchant of Record. Paddle is responsible for:

Your purchase contract is between you and Paddle. These Terms govern your separate license to use the Software once purchased.

3.2 License key delivery

After successful purchase, Paddle will email you a unique license key. You are responsible for keeping this email and the license key confidential. Lost license keys can be retrieved through Paddle's customer portal (a link is included in the activation email).

3.3 Activation

The Software requires activation before any destructive functionality is enabled. Activation:

3.4 Hardware changes and reinstalls

If your Mac's hardware identifier changes due to logic-board replacement, an Apple repair, or a clean macOS reinstall, your Single Mac license may stop validating. In that case, email adi.vizgan.business@gmail.com from the address used at purchase, briefly describing what happened. The Provider will reset the activation at the Provider's reasonable discretion so you can re-activate on the repaired or reinstalled Mac. This courtesy is not a contractual right and may be denied where abuse is suspected.

4. NO WARRANTY

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR QUIET ENJOYMENT.

THE PROVIDER MAKES NO WARRANTY THAT:

The Provider does not warrant the conduct of Paddle. Issues with Paddle (payment failures, billing disputes, refund delays) must be raised with Paddle directly.

5. Updates and versions

5.1 Included updates

Your purchase includes all bug-fix and minor-version releases within the major version you purchased (e.g., a purchase of 1.0 includes 1.1, 1.2, 1.x.y, etc.) at no additional cost.

5.2 Major-version upgrades

Major-version releases (e.g., 2.0, 3.0) are not included with your existing license. The Provider may offer discounted upgrade pricing to existing license holders, at the Provider's sole discretion. The Provider is under no obligation to release any specific future version.

5.3 Support window

The Provider commits to releasing security and macOS-compatibility fixes for the major version you purchased for at least eighteen (18) months after the initial release of that major version. After that period, continued use is at your own risk; the Software may continue to function but is not guaranteed to remain compatible with newer macOS versions.

6. Refunds

6.1 Refund window

A fourteen (14) day refund window from the date of purchase applies, in line with EU consumer-rights law (the Consumer Rights Directive, 2011/83/EU).

6.2 How to request a refund

Refund requests must be submitted through Paddle's customer portal (a link is included in your activation email). The Provider does not process refunds directly.

6.3 Effect of refund

Upon a refund being granted:

6.4 Refund denial

Paddle and/or the Provider may deny a refund request where there is evidence of:

7. ASSUMPTION OF RISK

YOU EXPRESSLY ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SOFTWARE, INCLUDING THE RISK OF PERMANENT DATA LOSS AND THE RISK OF AN UNUSABLE OPERATING SYSTEM.

You acknowledge that:

You agree to verify, by your own independent judgment, that any item you authorize the Software to delete is in fact one you wish to delete.

8. SAFEGUARDS, NOT GUARANTEES

The Software contains a SafetyGuard mechanism that attempts to refuse destructive operations on a denylist of known system paths (/System, /usr, /Library/Frameworks, ~/Library/Keychains, etc.). This denylist is best-effort and incomplete:

The presence of the safeguard does not transfer responsibility from you to the Provider for any deletion the Software performs.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE PROVIDER BE LIABLE FOR ANY:

even if the Provider has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

If, despite the above, the Provider is held liable for any claim arising from or relating to the Software, the Provider's total aggregate liability shall not exceed the Purchase Price you paid for the Software (net of any taxes and Reseller fees that the Provider did not actually receive).

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Provider, its contributors, and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

11. Privacy and data collection

11.1 On-device scanning

All file scanning, hashing, and analysis performed by the Software occurs entirely on your Mac. No file contents, file paths, or scan results are ever transmitted to the Provider.

11.2 Activation telemetry

The Software contacts the activation endpoint in two situations only:

  1. Initial activation, after you enter a license key;
  2. Periodic re-validation of the cached activation token (no more than once every 30 days).

These requests transmit only your license key, the Software version, and an anonymized one-way hash of non-personal hardware properties. No personal information, file contents, file paths, or usage statistics are transmitted.

11.3 Paddle data

Paddle processes your name, email, and payment information as part of the purchase. Paddle's privacy practices are governed by Paddle's own Privacy Policy, which you accept as part of the purchase transaction.

11.4 Privacy Policy document

A separate Privacy Policy document accompanies these Terms. In the event of a conflict between this Section and the separate Privacy Policy, the separate Privacy Policy governs.

12. ELIGIBILITY

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the right and authority to use the Software on the macOS computer(s) on which you install it. The Software is not intended for use on Mac computers managed by an employer, school, or other organization without that organization's permission.

13. TERMINATION

These Terms apply until terminated. The license granted in Section 1 may be terminated by:

  1. You, by ceasing to use the Software and uninstalling it.
  2. The Provider, at any time, for material breach of these Terms, including but not limited to:
    • sharing or publishing your license key;
    • attempting to bypass, tamper with, or reverse-engineer the activation mechanism;
    • fraudulent purchase or chargeback;
    • using the Software in violation of applicable law.

Upon termination by the Provider for breach: your license is immediately revoked, your activation token will be invalidated on next online check, you must stop using the Software and delete all copies, and no refund is owed for breach-based revocations.

Sections 4, 7, 8, 9, 10, 11, 17, and 18 survive termination.

14. CHANGES

The Provider may revise these Terms from time to time. The latest version is included with each release of the Software and posted at the Provider's website. Material changes will be highlighted in the release notes of the next Software update following the change. Your continued use of the Software after changes are published constitutes acceptance of the revised Terms.

15. INDEPENDENT CONTRACTORS

Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and the Provider. Paddle is an independent third party and is not the Provider's agent.

16. ASSIGNMENT

You may not assign or transfer these Terms or your license, by operation of law or otherwise, without the Provider's prior written consent. The Provider may assign these Terms freely (e.g., in connection with a sale of the business).

17. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from or relating to these Terms or the Software shall be brought exclusively in the competent courts of Tel Aviv-Jaffa, Israel, and you submit to their personal jurisdiction. This does not deprive you of any non-waivable consumer-protection rights you may have under the law of your country of residence.

18. SEVERABILITY

If any provision of these Terms is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with Paddle's terms applicable to your purchase and the Provider's separate Privacy Policy, constitute the entire agreement between you and the Provider regarding the Software and supersede any prior agreements.

20. CONTACT

For questions about these Terms or the Software, contact the Provider at adi.vizgan.business@gmail.com. For purchase-related questions (invoices, refunds, billing), contact Paddle through the customer portal linked in your activation email.

By clicking “I Agree,” activating the Software with a license key, opening the Software, or otherwise using the Software, you confirm that you have read, understood, and agreed to be bound by these Terms.
